- ACCEPTANCE OF TERMS
By accessing or using newportfuncharters.com (“Site”), you agree to these Terms of Use. If you do not agree, you may not use the Site.
2. SERVICES
Newport Fun Charters provides private yacht charters aboard the 65’ Chris-Craft Roamer “DEO JUVANTE”. Bookings are secured with a 50% non-refundable deposit. Remaining balance is due on the day the contract is signed.
3. CANCELLATION POLICY
Once a date is secured, it cannot be canceled. A minimum of 7 days’ notice is required for any changes. Payment is non-refundable at all times.
4. LIABILITY AND DAMAGES
A loss/damage liability form must be completed and a credit card placed on file prior to departure. Additional charges may be assessed for excessive cleaning or damage beyond normal use. Newport Fun Charters reserves the right to refuse service to anyone, including intoxicated guests, to maintain safety.
5. INTELLECTUAL PROPERTY
All content on the Site, including text, images, logos, and designs, is owned by or licensed to Newport Fun Charters. Unauthorized reproduction or distribution is prohibited.
6. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Newport Fun Charters disclaims all warranties and will not be liable for indirect, incidental, or consequential damages. Our liability in any case is limited to the amount paid for the charter service.
7. INDEMNIFICATION
You agree to indemnify and hold harmless Newport Fun Charters, its owners, employees, and affiliates against any claims, damages, or expenses arising from your use of the Site or participation in our services.
8. FORCE MAJEURE
We are not responsible for delays or cancellations due to events beyond our control, including weather, natural disasters, or governmental actions.
9. ARBITRATION AND GOVERNING LAW
These Terms are governed by California law. Any disputes will be resolved through binding arbitration in Orange County, CA, under AAA rules.
10. ENTIRE AGREEMENT
These Terms, along with our Privacy Policy and signed charter agreements, constitute the entire agreement between you and Newport Fun Charters.
11. CHANGES TO TERMS
We may modify these Terms at any time. Continued use of the Site after posting constitutes acceptance of modifications.
